 Pretrial Intervention

       The Midland County District Attorneys Office operates a Pretrial Intervention Program.  The purpose of the program is to divert certain persons charged with criminal offenses from formal prosecution under the criminal justice system into a  rehabilitation program.

       Pretrial Intervention is offered to first time offenders. An applicant will be required to participate in classes directed at rehabilitating the person. In addition, the applicant is required to pay a $500 fee and any restitution owed prior. The Pretrial Intervention Program does not exceed two (2) years. A person charged with the offense is required to fill out the written application to enter the Pretrial Intervention Program. The applicant will also be required to sign a waiver of right to a speedy trial, waiver of right to trial by jury, and an admission of guilt to the offense(s) charged. These documents are admissible against the applicant if they fail to successfully complete the Pretrial Intervention Program. In addition, the applicant will also be required to sign a waiver of right to an expunction. A link to these applications are at the bottom of the page.

      The completed application needs to returned to the Midland County District Attorney's Office. The application can be downloaded from the links below. Once it is received, the applicant will be contacted by a Pretrial Intervention Facilitator who will schedule a time for an intake interview. The applicant must appear for intake. Failure to appear will result in removal from the program. The policies and procedures of Pretrial Intervention will be explained during the intake interview. The applicant must complete all components of the program in order to be successfully discharged. If an applicant fails to complete all components, they will be notified in writing of their noncompliance and placed back on the trial court's docket.
