IMPACT OF THE POINT SYSTEM UNDER THE TEXAS DPS DRIVER RESPONSIBILITY PROGRAM

APPLIES TO CONVICTIONS OCCURING ON OR AFTER SEPTEMBER 1, 2003 INCLUDING CONVICTIONS FOR OUT OF STATE TRAFFIC MOVING VIOLATIONS

POINTS ARE ASSIGNED AS FOLLOWS:

2 POINTS FOR EACH MOVING VIOLATION
3 POINTS FOR A VIOLATION RESULTING IN AN ACCIDENT

NO POINTS ARE ASSIGNED IF THE OFFENSE IS A SAFETY BELT VIOLATION OR SPEEDING AND THE ALLEDGED SPEED IS LESS THAN 10 PERCENT FASTER THAN THE POSTED SPEED LIMIT.
CHILD SAFETY SEAT VIOLATIONS ACCRUE 2 POINTS

NO POINTS ARE ASSIGNED IF THE CHARGE IS DISMISSED BY COMPLETING DEFENSIVE DRIVING SCHOOL OR DEFERRED ADJUDICATION

THE ANNUAL SURCHARGE FOR A PERSON WHO HAS ACCUMULATED 6 OR MORE POINTS WITHIN A 36 MONTH PERIOD IS A FOLLOWS:

$100 FOR THE FIRST 6 POINTS PLUS $25 FOR EACH ADDITIONAL POINT. POINT SURCHARGES ARE CUMULATIVE AND MAY VARY WITH EACH ANNUAL ASSESSMENT IF CONVITCIONS ARE ADDED OR REMOVED FROM THE DRIVER RECORD.

THE TEXAS DEPARTMENT OF PUBLIC SAFETY IS REQUIRED BY LAW TO NOTIFY A LICENSE HOLDER WHEN THE LICENSE HOLDER HAS ACCUMULATED 5 POINTS

THERE IS A SPECIAL SURCHARGE OF $250 PER YEAR FOR A LICENSE HOLDER WHO IN A 36 MONTH PERIOD IS CONVICTED OF AN INSURANCE VIOLATION OR FOR DRIVING WHILE LICENSE INVALID.

A PERSON CONVICTED OF DRIVING WITHOUT A VALID LICENSE IN A 36 MONTH PERIOD IS ASSESSED AN ANNUAL FEE OF $100. THIS INCLUDES NO DRIVER LICENSE, NO COMMERCIAL DRIVER LICENSE, NO ENDORSEMENT VIOLATIONS, NO MOTORCYCLE LICENSE, OPERATE WITH LICENSE FOR OTHER CLASS VEHICLE.

THE DEPARTMENT OF PUBLIC SAFETY WILL SEND A NOTICE AND STATEMENT OF ANY SURCHARGE ASSESSED. FAILURE TO PAY THE FEE WHEN REQUIRED RESULTS IN AN AUTOMATIC SUSPENSION OF THE DRIVER’S LICENSE AND REMAINS SUSPENDED UNTIL THE FEES ARE PAID

THERE ARE FEES OF $1,000 TO $2,000 FOR OFFENSES INVOLVING INTOXICATED DRIVER OFFENSES.
