Plea Response
You enter one of the following pleas in court:
- Nolo Contendere (No Contest): means you neither admit nor deny but accept the conviction and punishment, to avoid a trial. If eligible you may request a Defensive Driving course or Deferred Adjudication.
- Guilty: admitting that you violated the law and have no defense or excuse for committing the offense.
- Not Guilty: is informing the Court that you deny guilt of the charged against you. You may request a Bench Trial with the Judge, or a Jury Trial. You have the right to have an attorney to represent you, but the Court is not required to provide you with an attorney.
Defensive Driving
With few exceptions, you have the right to complete a driving safety course if you are charged with violating the traffic laws. You do not have the right to complete the course if you hold a commercial driver’s license, if you held a commercial driver’s license when the offense was committed, if you are charged with passing a school bus, failing to stop and give information or render aid following an accident, or a traffic offense committed on a construction and maintenance work zone while workers were present, or if you were speeding 25 miles per hour or more over the posted speed limit.
Deferred Adjudication / Disposition
Deferred Adjudication/Disposition is another option to dismiss a traffic ticket in Texas. The request must be submitted to the Court; the request is reviewed by the Judge. The Judge, then either grants or denies the request. If granted the person pays Court fees and is placed on a 60-to-180-day probation period. If they do not get any other traffic tickets within the probation period, the citation will be dismissed.
As of September 1, 2003, you are not eligible for Deferred Disposition if you possess a Class A or B driver’s license, even if you are in a personal vehicle.
